Andrew Yang is Forcing All Volunteers in His Campaign
to Sign Sweeping Non-Disclosure Agreements (NDAs), Aaron Foldenauer Discovers

“Donald Trump was widely criticized for requiring his staff to sign Non-Disclosure Agreements.  Andrew Yang now stoops to a new low by requiring even unpaid volunteers to put their assets at risk and sign sweeping NDAs,” said Aaron Foldenauer, Candidate for Mayor of New York City.

NEW YORK, NY, January 26, 2021.  –  Andrew Yang is requiring all of his volunteers to sign sweeping non-disclosure agreements in connection with his campaign for Mayor.  This was discovered after a source connected to the Yang campaign gave Aaron Foldenauer, one of Yang’s opponents in the upcoming Democratic Primary in the race for Mayor of New York City, a copy of the NDA.

“Yang’s requirement that his volunteers sign sweeping Non-Disclosure Agreements demonstrates that Andrew Yang’s claim that he wishes to be a progressive and ‘open and transparent mayor’ is a pure lie,” said Aaron Foldenauer, Candidate for Mayor of New York City.

Yang’s choice to silence his volunteers follows his decision to delete his tax returns from his website and use campaign funds to pay himself and sell his own books, decisions that were also uncovered by Aaron Foldenauer.

“One of the most odious terms in the NDA is Paragraph 8, which requires a volunteer to snitch on other members of the Yang campaign who violate their NDA,” said Foldenauer.  “I am amazed that the Yang campaign would go to such lengths to find rats within the Yang Gang.  What is Andrew trying to hide?”

That provision, Paragraph 8 of the NDA, requires volunteers to “promptly report to the Campaign any and all unauthorized disclosures or uses of any Confidential Information.”

“Worse yet, a cleverly worded footnote in the NDA broadly defines ‘Confidential Information’ subject to the NDA to bar volunteers from discussing things such as ‘past, current, or planned’ ‘opinions’ and ‘policies’ related to the Yang Campaign,” said Foldenauer, who also is an attorney.

“This sweeping NDA is poorly drafted and I feel sorry for any member of the Yang Gang who was forced to sign it,” said Foldenauer.

Paragraph 10 of the NDA provides the Yang campaign with a broad right to sue any volunteer for damages in court if a volunteer “violate[s] the commitments listed above in any way.”

“Donald Trump was widely criticized for requiring his staff to sign Non-Disclosure Agreements.  Andrew Yang now stoops to a new low by requiring even unpaid volunteers to put their assets at risk and sign sweeping NDAs,” said Foldenauer.  “Andrew Yang should know better.”
